EVGA_JacobF Hey guys, I just would like to mention that we are working on an X79 Dark program for existing EVGA X79 owners. I don't have any further details at this time but please stay tuned for more details. Very smart move. A Class action law suit over this could bring a company to a crashing holt.

They could cut their losses because people will buy this board (X79 Dark) and just give the silent middle finger to current X79 customers. Since you know they really don't have to do anything for the current people but damn...if they do offer you guys a good will gesture A+ EVGA.

I'm really glad to hear that even though I don't own one. I've read through all the complaints as well as keeping an eye on the progress of the X79 Dark board. It takes a "bit" of my reluctance away from going to the X79 Dark after reading this...

Nice move EVGA... I'm fortunate in that my experience is less problematic as others. Yeah... I get the occasional drop out on the USB ports... but heck. I can live with that for now. I'm just glad EVGA is addressing problems for those who have far more pressing needs than I. Thank you.

I was going to say, I am sure it will decent offer. Some will like it others will not, I just want to be made whole. If an little extra cost is involved it will hurt a little but will NOT kill me AND my computer will work a LOT better! ( which is all I ever wanted anyway, a 100% working MB!) :-)

bcavnaugh dustingg Very smart move. A Class action law suit over this could bring a company to a crashing holt. And a fool of you and anyone who joins you. What are you going to sue over, what you can't Overclock to 6 GHz or can't set the Voltage to 2.0, What? Do you want EVGA to come to a "crashing holt" and close the doors and stop making Videos Cards as well which I see you do own one. If all you are going to do is Threat and Bash EVGA on this Forum then it is time for you to leave. If you need to vent then be professional about it and use private email or snail mail. And we all wonder why the US is going to He!! OK I said my peace, sorry it had you be you but user after user all they seem to do on this forum now is complain about how nothing works for them, I won't say why or you may bring a "Class action law suit" on me. Bill If I were an EVGA Forum Moderator I would be fired now. >_> You know the fact that their products don't work as advertised and they refuse to give a refund and can't fix the issue is more than reason for a class action lawsuit. EVGA should of have had offered a full refund to everyone that purchased a motherboard since p67. Forums are here for open discussion but sorry for not using it just to praise evga on how crappy their motherboards are.

I'd check the fine print.. chances are there's a 30-day return policy or something similar (depending where you purchased the motherboard from), which you agreed to when you made the purchase. If you chose not to return the motherboard in those first 30 days, then offering repeated RMA's would mean EVGA are keeping to their contractual obligations, so you wouldn't have a leg to stand on legally (IF those were the terms of purchase). That doesn't mean EVGA shouldn't do something for you, if for no other reason than to maintain arguably one of the highest levels of goodwill in the industry. Just saying... best to check that out before threatening class-action lawsuits etc..

You're not doing yourself any favors mate, for a variety of reasons. I suggest you talk to your 'awesome lawyer cousin' before you mouth off here any further - he should quite easily be able to point out how you've already shot yourself in the foot as far any any chance of a successful lawsuit goes, primarily because of what - and more importantly when - you have commented on this thread. If he is any good at all, his first advice would be to tell you to stop posting here. Just an fyi, yes, I do have experience in this field in my employment.

A good step up program with a FULLY tested MB to make all my problems disappear, I would then be one happy guy! I don't really built a Rig every year, usually every 2-3 so I can save money to the top end the next time around... Which would mean I would most likely be happy for awhile! I am hoping all this delay time is just so it will be bug free when released to the masses... It may have been a long time coming but IT IS coming and for that I am thankful. I have my hopes up but like everyone has said before the proof will be in the reviews and users...

There are a lot of strong opinions for and against the topic but we ask that everyone continue to try and keep this thread clean. It is a very important subject and we want to keep the thread open. Thanks for your understanding in this matter.
