Considering how few KPE cards have been purchased / shipped, how hard would it really be for EVGA to narrow down who is getting their card this Friday (as the listing mentions), and take action?

EVGA should buy them back, look up the Serial Numbers associated with the item and look at the account it was purchased from, and cancel their account and ban future sales. I know it wont happen because its a net loss on profit and not EVGA's responsibility, but would be funny to see. Death to the scalpers! 

The net loss of a couple thousand (on 1 card) in comparison to the good will it would create for their customers and brand loyalty is well worth chalking up to a very inexpensive marketing expense.  They would also need to make a big deal out of it to make sure they get credit for that good will.  That being said, with the amount of cards being purchased with the sole intention of reselling on a secondary market, they can't do the same for every single one of them.  But just doing it for KPE since it's a very limited run wouldn't be out of the question.

Highest i was able to get on my KP on PR is 14,850 with the LN2 bios. My 3090 ftw3 ultra gets 14,600 on PR. That's a 1.7% difference in performance. 1.7% is a low enough number that I can say that it is likely due to chance or silicon lottery and not engineering differences.

 
I experienced this with last gen's Kingpin too, but mine was actually worse... my KP couldn't hit 2145 stable even with classified tool.  My 2080 Ti XC Ultra (reference board) is able to hit 2160 with a power limited bios of 338w...And no I did not do LN2.
 
Ended up returning it and eating a $300 restocking fee.  I'm sure these are binned chips, but with how scarce the 3090 silicon is, the binning margin is probably top 50% of clockers rather than top 20%. Your story makes me really nervous to throw down 2k on another

My EVGA 2080Ti Black can hit hit that sometimes. Can't hold it because the temps run at like 64c and it just bounces off the power limit. it has the stock BIOS. Bottom of the barrel card, that may have won the Silicon lottery. My best PR score is around 9,800 I think. I actually wanted to spend more time with it, but from what I understand, I would not have been able to flash a better VBIOS on there.

That makes me think that this was just a straggler drop from last Wednesday's drop...maybe EVGA waited a few days to see if folks contacted them due to missing the email around the holiday period.  Hopefully the next good news is of a materially bigger drop.

Ground shipping was like 21 for me with the fastest shipping being 62 I believe. I just went with ground shipping since ups isn't guaranteeing their shipment times at this moment in time.
