That's literally what we're talking about.
Read my post above your reply. "obtaining money or property by means of false or fraudulent pretenses" requires 'defrauding' the victim. Violating EVGA's ToS does not defraud EVGA. EVGA is not depraved of value if EVGA is paid their asking price. Violating ToS != Commiting a crime.
But this is getting way off topic of the cards though... shall we return to the point of the thread?
I read it after I posted and it's inaccurate. There is a separate crime "Theft by false pretenses" that requires what you stated above. There are also statutes that couple the two things together (larceny/defrauding/embezzlement). There are also statutes that use the phrase but not in relation to that specific law (yay common law systems and terminology). It's definition depends on the context of the statute it's in. In the context of the mail fraud statute, defrauding is not required because defrauding is called out specifically in its own part. Yes but "fraudulent pretenses" has defrauding baked into its own definition. You cant change the meaning of that crime simply because defrauding is listed elsewhere in the statute. You can absolutely defraud someone without false pretenses... but The crime of False Pretenses requires defrauding. Square/Rectangle Rectangle/Square. Federally the term "Obtaining Property under False Pretenses" was clarified by BELL v. UNITED STATES(1983) where the case was affirmed as correct, because the victim was depraved of a thing of value... that being money. If you're buying something at asking price you are not obtaining under False Pretenses. Well EVGA "enabling" people to get 3 GPUs when there is a very short supply means 2 "regular people" won't get to buy theirs. That's... why some people care.
Some people seem not to understand how distribution businesses work... EVGA has always been 2 per household, you either buy 1 or 2 and if you're late to the game or can't afford it at the moment, oh well life goes on. It ain't the first time or will it be the last time.

Any idea when prices will be released? I'd rather have a evga 3080 ftw than a founders edition bit I don't see any prices listed on the card.
Also, is the 3080 page you have listed on the main evga page the actual place to buy the card or will there be a store section for them.

I'm curious about the specs for the Hydrocopper. I'm currently using Hydrocopper for my 1080 Ti and since I've ghetto modded my case with my pump I literally have less than a millimeter between the card and the reservoir. Is the new Hydrocopper the same in length (other dimensions doesn't matter)?

- Currently no pre-order planned. Similarly, no pricing is available at this time.
- Like the US store, we cannot generally comment on availability at this time for the EU store. Availability, however, will not be any sooner than the dates NVIDIA mentioned for each GPU.
- HYBRID, HC, and KPE cards will come a bit later than the XC3 and FTW3 cards. No ETA to give you, which is probably your next question.
- HYBRIDs will be 240mm, except for KPE HYBRID, whch will be 360mm. No plans for a 120mm HYBRID at this time.
- HYBRIDs will be 2 Slot.
- XC3 cards will all be 2.2 slots. Length is 11.23in. - 285.37mm / Height is 4.38in. - 111.15 mm.
- FTW3 cards will be 2.75 slots. Length is 11.81in. - 300mm / Height is 5.38in. - 136.75mm.
- There will be an EVGA NVLINK. No ETA at this time.
- Since I've seen this mentioned incorrectly, all cards are 3 DisplayPort, 1 HDMI.
- PowerLink is expected to work with the XC3 models. For obvious reasons, it will not work with the 3090/3080 FTW3 cards due to the number of PCIe power connectors. Either way, we will have the compatibility list updated when the cards are available on the website.
- Step-Up will begin when cards are available. Products will not be listed prior to general availability. I would expect one of the XC3 models will be listed for availability, but we will make that decision prior to general availability.
- I'm not sure why people assume bots are buying cards over regular people. It was a popular reason for why 20-Series cards were always out of stock, which completely ignored literal supply and demand issues (lots of people wanted them, but there weren't many initially). Yes, there are per person quantity caps for each card. Yes, we require captcha to login, which is also required to create a profile. This should help to comfort some of you.
Hi does anyone know if the lengths include the bracket or not? Trying to figure out if it'll fit in my case.

ComboSlicer So many people asking lengths - just get a normal case instead of gimped down to the max matches box so there wouldn't be a paranoia "is it going to fit". Would understand if we talk about the price but mid sized cases ain't more expensive than these tiny cases people seemingly hoard.
It isn't always about costs. For me personally ITX cases look better and I have more options on where it is located.
Agreed, I've got a couple cases floating around that would fit any of the new cards, but I don't want to use them over my much nicer NCASE M1, considering one of the reasons I bought was so I could have my PC on my desk without having a big tower sitting there (I consider most mATX cases 'big' nowadays). All three of my computers have actually migrated to being mITX at this point. I mean, when I was a kid I didn't care what case I had as long as it held my components, but now that I've turned into a middle-aged guy I'm much more selective about it. Kinda similar to how I grew out of RGB a long time ago. (except for my mouse, I like having RGB on my Nyth so I can have it change colors based on the profile that's active, depending on the game)

Looking forward to getting a FTW3 Ultra, so I can slap a waterblock on it later. Kingpin is very attractive as it got a proper cooler already, but the more than likely price of 2000-2200€ is a bit offputting. Pulled the trigger a bit too early and got a non A 2080 ti, thankfully I could still do 2100/8000Mhz oc. This time I'll wait until custom bcb cards are readily available, which is probably next summer. Will also need to grab a LG gn950 go with this extra level of performance, and make the current 1440p a secondary.

It changes too much. We've heard "soon" for this time around, but nor real dates. I personally advise against the pure HC because it means you don't have a backup cooler if anything goes wrong, it's harder to sell it back if that's what you want to do (or pass it down to friend and family), and apparently some people had huge performances problems with the 20 series.

Having had aio's for cpu for years and recently swapped my 770 to an AIO with the G12 bracket kit, i'm certain thats the one I want, im yet to find an air cooler I'm happy with the noise levels and cooling performance of, they're either too hot or too loud, but also not prepared to go full open loop just yet. The hybrid card is perfect for what I want

ive run my fans full time @ 60 TO 70% USING msi afterburner for years now a760,780,980ti classified and a 1080ti all EVGA cards.temps have always been below 70c and never had a fan failure or been noisy.

For CPUs there are definitely coolers that hold their own against AIOs. Assuming you have a decently sized case. For GPUs it's harder because the 3rd party market for GPU coolers is basically non existent these days. It used to be you could buy a Zalman that would be better than some stock coolers for instance. Anyway. Not denying it won't perform or anything. Just that at this point, 2 AOI, you're buyind pumps and radiators twice. Everytime. It's kind of a waste :-) Going custom watercooling loop is a bit intimidating but these days it's really not that hard. Just my $.02. That being said, yeah we still don't know exactly when they will release :-/

For me, can't go with the Hybrid cooler simply because it's a 240mm. Hoping to upgrade my CPU's cooler to a 360mm placed at the top of my case, leaving only the back 120mm slot available for a GPU AIO. Anyway, heard they can be noisy and problematic anyway so FTW3 ftw!

Pulled the trigger a bit too early and got a non A 2080 ti, thankfully I could still do 2100/8000Mhz oc. This time I'll wait until custom bcb cards are readily available, which is probably next summer. Will also need to grab a LG gn950 go with this extra level of performance, and make the current 1440p a secondary.
