I wish Nvidia/AMD would make demands from their etail partners not to allow scalping on their platform marketplaces for at least 3 months after release. It wouldn't help a ton, but it would give scalpers fewer options and once only ebay is left, they could potentially put some pressure on them because all major stores and brands sell on Ebay too. Nothing you can do about local sales though.
 
But even if there was some system where absolutely nobody pays more than MSRP for their own cards, it doesn't mean anyone who is still without a card will have gotten one by now. The demand is simply far too high and the supply is far too low. All that some hypothetical perfect anti-scalping system would do is slightly change the already somewhat random order that people get their cards, the actual amount of owners would be roughly the same. 
 
 

This only applies to 3090's.  Someone posted that a shop in Europe has only a 2:1 ratio of people who want a card vs cards coming in, while for 3080's its's 25:1.
So the demand is lower, and a lot of people have 3090's now, and there is too small of a market of people willing to pay $1700 for a video card, so it's becoming too much of a risk to scalp, since scalpers are competing with other scalpers.
 
For 3080's and 3070's' it's still a circus and a half.
 
So even if it's getting easier for normal people to get 3090's, that's not going to help the average gamer who can't afford something that's more expensive than a super high end motherboard, CPU and high binned b-die memory combined...

It's because this card sucks dude.   I have a 3090 FTW Ultra,  on my SECOND RMA.  Praying my next replacement doesn't pull 80+ watts from the PCI-E slot.  You want proof of this,  Look up the Asus Strix 3090,   still going for 2400!!    Look up the PNY,  Gigabyte,  they've been available at near msrp for over a month.  

I had an Asus TUF 3090 for weeks before and had less issues than this thing.   Even with the "updated Beta bios"  Strix beats it.  Hands down.    Couple that with EVGA's support going downhill a bit,  its not looking good.   I thought they were bigger but apparently not and if they're already getting some bad seeds in terms of customer service,  YIKES.   I'm dealing with having a post censored right now! They're in full panic mode I think on this.  :/  

I know it sucks but I say just wait it out and get it from an retailer

Time is no longer guaranteed to bring prices down, unfortunately there are alot of variables at play that can have them rocket right back up (supply/demand, crypto currency value increasing, MSRP went up due to both: material costs been going up, import tariffs just went up).

It's limited to the EVGA 3090's. Word is out that it's failure rates are above average. The Strix is still fetching a premium. (~$2,500)

Edit: Pointing me to threads here (and anywhere else) is anecdotal at best. I want actual proof, not "well, 150 users complained"....that's not proof.
I'm quite sure I can find 150+ Asus users who are pissed about something failing on their cards too.....if I bothered to look..which I won't.

Disregarding the "study" in this thread, I went to eBay and just looked at completed listings for each card, the 3090 Stix and FTW3 Ultra. It does appear the Stix is still pulling a premium vs the EVGA. One can assume that it has to do with the 3090 FTW3 Ultra failure rate, but it does not mean they are correct.  Regardless of who is right or wrong, whether or not the failure rate is a true concern is irrelevant. It only has to be perceived as a concern.

And BTW- people paying over MSRP are making an emotional purchase. So ‘word on the street’ has a big impact on their choices.

Failure rates could only come from the respective companies. They NEVER release the data due to competitive advantage.

Swedish store inet.se has 50+ in now, they do have high prices on all EVGA cards tho.

Is it a scalper defeat? Or is it more no one wants to pay that much for a gpu in the first place so he probably didn't have a whole lot of buyers lined up on top of not having enough people willing to pay that high. I don't think that "defeat the scalper" logic would apply to 3080's would it? 

Check again prices have gone up...
