It frustrates me to know that this cop is still employed by the NYPD, they actually still have him on duty, just behind a desk instead of on the streets. When you have someone tell you they can't breath, you need to let go. Not when they don't have a legit reason. I'd be pissed if I was being wrongfully accused and arrested. The guy in the video kept saying that he just broke up a fight. The police department said the arrest was for untaxed goods. Something is wrong here and it definitely looks like the whole situation was mishandled by the police. It just doesn't make sense to have 5+ police on the scene for a arrest on untaxed goods.

Police officials said Garner had a history of arrests for selling untaxed cigarettes. Cops said they observed him selling his wares Thursday on Bay St. and moved in for an arrest. "he balked at being handcuffed." His weight and Health "was unable to work because he suffered from a host of ailments, including chronic asthma, diabetes and sleep apnea." was more of the factor of his death from a Records show Garner was due in court in October on three Staten Island cases, including charges of pot possession and possession or selling untaxed cigarettes. It is still sad though. Also the key here is "refused orders" "When HE refused orders to put his hands behind his back, one of the plainclothes cops, wearing a green T-shirt with a yellow No. 99 on the back, got behind him and put him in a chokehold, the footage shows."

Yeah, that's called misdirection. The police are clearly in the wrong on this one.

Guy resisted arrest....and was very unhealthy....a bad combination. Very sad that this happened......but if you live a drama free life this most likely won't happen to you.

There is a big difference between resisting and avoid. I did not see resistance or him assaulting an officer. I saw him not wanting to be touched, he didn't swing or provoke a fight. In fact, his palms were faced outwards the whole time... Meaning zero resistance other than being upset. He was instantly choked, slammed to the ground and face smashed with a knee to the back of the head and when he said he couldn't breath, that knee just pushed his face harder into the ground. If you guys can't see this for what it is, your blind and deaf.

Is there any proof other than the road pirates word that he was "selling" anything? Probably not most cops are trained to lie and coerce you into complying. How about the 51 year old woman who was beaten two weeks ago by a California Highway Patrol officer? He is still employed... Police are allowed to police themselves and are protected by a Police Bill of Rights in most states.... This has to end badges don't grant extra rights.

Lucky you are, you seem to have only a few such incidents. Here in Russia such things happen daily. Our cops wound and kill people, and the worst punishment is "you are fired". I don't want to say all our cops are monsters, but there's too many of them.

Poor guy, I hope that his family gets justice. This is very unfortunate, I really dislike it when stuff like this happens. Not only is it a a crime done by someone who was suppose to uphold the law, but helps tarnish the reputation of law enforcement. I have a lot of respect for law enforcement but people who abuse their power, let's just say that I see them no different than locked up criminals.

Chances are the most this guy will ever get is a slap on the wrist and suspension without pay, i.e. a forced vacation. I normally side with the police on most matters, after all the people they have to deal with are generally a bunch of dirtbags. But to kill someone in custody, especially for something as trivial as selling untaxed goods, is absolutely ridiculous. Not paying your fair share of taxes doesn't seem like it warrants the death penalty to me.

Brad is technically correct, and height/weight *is* used to figure that classification. He was 6'4" and 400lb, that's a BMI of 48.7.. Normal BMI ranges from 20-25. An individual is considered morbidly obese if he or she is 100 pounds over his/her ideal body weight, has a BMI of 40 or more, or 35 or more and experiencing obesity-related health conditions, such as high blood pressure or diabetes (Garner had diabetes as well as chronic asthma).

That's the way I see it. Underlying medical condition. Probably succumb to cardiac arrest. I see disorderly conduct, disturbing the peace and the use of excessive force, well he was 400 pounds. I don't think I could take him. yes, he was morbidly obese. Medical definition is based on BMI (body mass index) I'm guessing 6 foot 5 inches 400 pounds. BMI is 47.4 No way he falls into any other category. - Underweight = <18.5
- Normal weight = 18.5–24.9
- Overweight = 25–29.9
- Obesity = BMI of 30 or greater

If you guys saw someone sell untaxed tobacco products could you legally go up to them and tackle them put them in custody then choke him out? Or if you saw a 51 year old woman step into traffic would it be acceptable for you to take her to the ground and start beating her in the face? Then claim she was resisting even though the video evidence shows she was clearly trying to block the blows to her face????? NO BECAUSE IF WE DID THAT WE WOULD BE ARRESTED PROCESSED GROPED AND JAILED FOR ATTEMPTED MURDER DEPENDING ON THE STATE!

this is tragic. Don't get me wrong. The way he was taken into custody isn't different from any other person who resists arrest. A guy that large, they control the head. He could speak, so he wasn't being choked to death. It could of been arterial obstruction and lack of blood flow to the brain- possibly. His head, if it did hit the pavement, didn't cause his death. He may of had a medical condition or heart condition that lead to this. He didn't cooperate with authorities. He was wrong for not cooperating and this caused him to be apprehended. The force used to do this may of precipitated a medical condition to show. He died because of his health. You can't tell from looking at people who will withstand being taking into custody and whom can't. If 5 or so cops were involved, I would say that that was needed to apprehend him. He was a large guy. Not one person caused his death. It's just circumstance of his poor health. This is sad all the way around. He should of cooperated and the cops should of evaluated if he was a threat and just left him alone. I don't know the motive for arrest. Was it disorderly conduct in public? Disturbing the Peace? Was it because he was selling illegal items? Time will tell.
