GTX 1070 SC is hitting Power limit at 96% Power

Hey,
 
for some reason my GTX 1070 is hitting the power limit even though its far from its power target.

    Thanks for the link. I have read all the posts but it seems like there is no solution for the problem. I also tried the batch file trick someone suggested (changed the value to 112% of the 170W base). 
     
    @ECHO
    start cmd.exe /k "C:\Program Files\NVIDIA Corporation\NVSMI\nvidia-smi.exe" -pl 190

     
    But it wont allow me to change the value to more than 170W. Do I need a different BIOS for this to work ?
    Is it possible to RMA my card because of the power limit issue ?

    One possible solution to the problem would be to do the shunt mod. RMA'ing the card won't fix the problem if the problem is related to the vbios on the card.
     
    Note: If you short the card out while doing the shunt mod your cards warranty will be void.
