EVGA Geforce 560 Ti - Very Poor Framerates until Reboot?

Hey guys,
 
I have been having some issues with my main PC, I am running the following specs-
i7 920 stock (2.6ghz I believe)
6gb Corsair DDR3 Memory
EVGA Geforce 560 Ti
Thermaltake PSU 750w (I believe this is the wattage, I am not at home so I don't have specs for everything exactly, models etc)
EVGA X58 Mobo
 
When I got this card everything seemed to run fine and I really did not have many problems. I got into BF3 beta months ago and ever since going to 280.xx (I believe) and up drivers for the beta I started to get the common 'kernal crash' errors people talk about. I have not had this issue since moving to newer drivers but I've started to experience an issue I can't find anything on.
 
When initially loading my PC, I can run a game and it will take a long time to load and I get very poor FPS. Initially I thought this was BF3 only but I've had the same problem in all games. If I reboot my PC games run probably 2 - 3x better than upon my first boot. Sometimes if I just turn on my pc, then reboot again right away and load a game I still have poor FPS. I also get about 20 fps even running optimally (after reboot) with SWTOR in many areas, PVP is also very laggy poor fps.
 
I recently updated to the beta drivers released just the other night (forget the version) and still see the same problems. I am not doing any CPU overclocking and I've increased GPU fan speeds to 85% to prevent overheating and I have done some very slight, marginal GPU over clocking using EVGA precision (doubtful this affects this issue, I have also set stock settings and still have the same problem).
 
Could this be a bad card? I will also note I have had some run ins with viruses multiple times and have had to clean up my system many times. I plan on making some changes to my system today since I just got a new SSD so I will be doing a clean Windows install.

    Sounds like its downclocking into 2d clock mode when it shouldn't be, i know this can happen if overclocked too high but your saying even at stock clocks its doing this. 
     
    Maybe its downclocking for no reason, check your clock numbers and see if they are at like 400 for core clock, if so its going down into 2d mode for some reason. 
     
    Other than that hopefully someone with more knowledge on this problem will chime in and help.

    I will double check when I get home, I do not believe this is happening but I can verify.

    Also when i say check the clocks i don't mean where you set/increase them in EVGA Precision, but in the little side window where it shows all the realtime clock speeds.
     
    Just to be clear because if its in a downclock mode your settings will still say what you have them set to and that will be your stock/OCed numbers, but the realtime window will say the actual clocks.
