I purchased EVGA RTX 3080 Ultra from a seller on Facebook Marketplace on oct 31st.  Seller provided me with picture of the receipt from Micro center.  I paid the seller with Venmo so I have picture of the receipt from Micro center and proof that I paid the original seller on Venmo.  Am I eligible for EVGA step up program?

Register your valid product within 90 days from your original purchase
    1. If your qualifying product has a 3 year warranty purchased on or after 3/1/2013 and registered within 14 days of the invoice date by the original owner from an authorized reseller, then you will receive the option to step-up for the first 90 days of ownership.

Can I Step-Up if I'm not the original owner?

No - Step-Up is available only to the original owner with a verified authorized invoice.

I didn't buy it used.  It was brand new sealed in a box and I already registered it for 3year warranty.

Hey, it's fine if you don't want to believe the program page about the "original owner." Get ahold of EVGA and ask them directly: https://www.evga.com/about/contactus/

per the terms you don't qualify for the step-up program, because you're NOT the ORIGINAL owner. But EVGA might over look it and let you step-up...

I have step up option on my evga account, but I'm not sure if they are going to approve it if I apply for step up program when they have 3080 Ti.

You have to upload the invoice, and they look at that before approval.

No.  Only the original owner of any eVGA product is eligible for Step Up.  There's no ifs ands or buts, it would be denied if you tried.
