Is this legit? Not sure if I should install it or not.... They also sent me a red lip version :(.....

    Contact EVGA and show them, but you should remove the S/N from the forums. If the sticker gets too damaged, EVGA can deny warranty on it - so that could be a problem for where that is located.

    Called support and was told to remove it and make sure they match. So did that and the card work I guess. Just upset about the fact I had to call again and spend more time on this card. Also upset I traded a black lip card for a red one with still the issue of going over 80w on the pcie slot.... Disappointed.

Also upset I traded a black lip card for a red one with still the issue of going over 80w on the pcie slot.... Disappointed.


    RMA it for being out of PCIE spec. The PCIE slot should read 67W or lower on a stock card since GPU-Z only reads 12V power and not 12V + 3V.

    There is one above the i/o bracket also, so I wouldn’t worry about warranty.

    Taking off either voids the warranty.  That is why they needed to contact EVGA and provide proof of the problem.  If they had just taken off the sticker without EVGA's knowledge and approval, any time in the future the that they tried to get a warranty replacement, EVGA would deny them saying that the warranty is void.  This has happened to people in the past, even though it seems like one sticker is redundant for the other.
     
    EVGA has some pretty childish warranty rejection tactics.

    The card is garbage anyway. Pcie power out of range and in game if the screen is dark, you can see snow in the picture. Nice.

    So the language is not enforceable unless over a screw? but if removed from another location its legal and enforceable? I've heard GN and others reference this but don't remember clarification if only over a screw and am genuinely curious.

    That sticker is prompted to come off, due to heat in the PCI-EX heat slot/socket or simply installing the GPU in the socket back and forward. Poor decision making on placing the sticker there. I would suggest to keep that pic in a safe for future RMA reference.

    I could understand if that was the only SN on the card then you'd need approval. But it looks like there is a 2nd SN printed near the pci-e bracket. So if they both match, you'd assume removing the one on the pci-e fingers wouldn't really matter since there is still an identifier on the card.

    Unfortunately, that isn't EVGA's opinion.  EVGA has voided people's warranty in the past for removing this redundant sticker.  Like I said, childish warranty rejection tactics on EVGA's part.

    I didn’t say to remove it.
    Obviously or maybe not, he had two stickers with serials. So if the one near the pci connector, got scratched up, he should have been fine.

    The only stipulation the ftc made in the letter they sent to the original 6 companies is that the device must be more than $15. Covering a screw, crossing a joint between two pieces, or slapping an informational sticker on something that may or may not hold are all the same thing in this case.

    So unless you get cards for significantly cheaper than the rest of us (sub $15), it would appear you are in the wrong.

    I had a network switch manufacturer try to deny a warranty because the warranty void sticker was clawed mostly off when it was installed in the rack.

    Had our lawyer send a short note to the switch company, and can you guess what happened?

    A: The immediately approved and processed the rma.

    B: All their switches no longer come with a warranty void sticker at all.

    You suppose they just decided to do that out of the kindness of their hearts? Or maybe, just maybe it was because they saw the ftc warnings and didn't want it further codified with a full court case.

    It's much more likely evga leaves these on for other countries where they can enforce it and it's more of a flag for them to inspect the card more closely.

    Is it an 80 or a 90? If 90 you can do what I did and use that special power balance / power limit RMA that Jacob offered if it's still being offered. Send screenshots of GPUz showing the power issue to 3090oc@evga.com

    Look in the warranty section of this forum. There was one denied warranty for this reason not very long ago. I don't have time to find the link for you at the moment, but I am sure that you can find it quite easily if you look.

    I removed it because it was edging onto the PCIE interface whenever I slotted in the card. I assumed EVGA only needed the warranty sticker and serial number intact, or at least has some sort of database that links the stickers back the serial/warranty number of the card. Here I am out another $1000, this is great start to 2021.

    Those are in regards to stickers preventing repair. This sticker normally is not in the way, and would normally void the warranty if you remove it. In this case, since it was in the way, EVGA gave special permission to remove it. As I and others said, this is why they needed to contact EVGA and provide proof that it was in the way, since it normally isn't.
     
    The users affected by this issue are protected by law since those stickers were incorrectly placed and did prevent the card from being used properly, but it would be a matter of legal action to reverse EVGA's decision to void the card's warranty.  Rather than seeking the messy legal action route, it's much easier to document the issue ahead of time and make EVGA aware, so that everything is taken care of.  That's why we told the person to contact EVGA prior to removing the sticker.
     
    If the sticker was placed properly and wasn't preventing proper use or repair, and the user removed the sticker anyway (or it otherwise magically disappeared), EVGA would (and has) decided to void the warranty.

    There is one above the i/o bracket also, so I wouldn’t worry about warranty.

    Taking off either voids the warranty.  That is why they needed to contact EVGA and provide proof of the problem.  If they had just taken off the sticker without EVGA's knowledge and approval, any time in the future the that they tried to get a warranty replacement, EVGA would deny them saying that the warranty is void.  This has happened to people in the past, even though it seems like one sticker is redundant for the other.
     
    EVGA has some pretty childish warranty rejection tactics.


    It should be noted this has been deemed unenforceable and actually illegal in the US per the ftc. Remove away. If evga denies it you have an open and shut case to sue them.

Warranty void stickers over screws are not enforceable, this is not over a screw and is very much enforceable because you typically would not need to remove the sticker for the card to function properly. This is an extenuating circumstance, but you should never spread this incorrect information no matter what.

    The only stipulation the ftc made in the letter they sent to the original 6 companies is that the device must be more than $15. Covering a screw, crossing a joint between two pieces, or slapping an informational sticker on something that may or may not hold are all the same thing in this case.

    So unless you get cards for significantly cheaper than the rest of us (sub $15), it would appear you are in the wrong.

    I had a network switch manufacturer try to deny a warranty because the warranty void sticker was clawed mostly off when it was installed in the rack.

    Had our lawyer send a short note to the switch company, and can you guess what happened?

    A: The immediately approved and processed the rma.

    B: All their switches no longer come with a warranty void sticker at all.

    You suppose they just decided to do that out of the kindness of their hearts? Or maybe, just maybe it was because they saw the ftc warnings and didn't want it further codified with a full court case.

    It's much more likely evga leaves these on for other countries where they can enforce it and it's more of a flag for them to inspect the card more closely.

    How do you prove the product is not counterfeit after removing a serial number? Please explain?

    If you say the backplate serial number, that could come from any card, which is why it MUST match the serial number on the PCI bracket.

    If you remove the serial on the pci bracket under normal circumstances, you can no longer prove that the card came from EVGA. Again, this is an extenuating circumstance.

    There is no joint this sticker goes over. This is nothing on the pcb that would typically need to be removed for standard thermal paste or thermal material replacement. This one instance is an extenuating circumstance where the pci serial number is covering the pci bracket and would affect function, but under normal circumstances, you would not be able to remove the sticker and provide any form of reasoning as to how you had to remove it to service your product.

    The FTC does not block companies from enforcing their serial numbers, the FTC blocks companies from denying warranting due to covering a joint or screw in an effort to deny warranty for standard and normal services like replacing a thermal pad or thermal paste. The two instances are not nearly the same.

    Feel free to reach out to the FTC for clarification, but you are interpreting the meaning wrong.

    Just so we can close this thread, EVGA Support had me remove the sticker and confirm the serial number on the backplate match the one on the PCI-E connector. I moved the sticker to the backplate, and they emailed with the details just so we had it on file that I was authorized to move it. No arms done but can you imagine if I didn't take notice of the placement... So weird...
