“Two years after I released CandySwipe, you released Candy Crush Saga on mobile; the app icon, candy pieces, and even the rewarding, “Sweet!” are nearly identical. So much so, that I have hundreds of instances of actual confusion from users who think CandySwipe is Candy Crush Saga, or that CandySwipe is a Candy Crush Saga knockoff,” he said on the official CandySwipe site, where there’s also a list of hundreds of app reviews stating obvious confusion between Candy Swipe and Candy Crush Saga.
“So when you attempted to register your trademark in 2012, I opposed it for “likelihood of confusion” (which is within my legal right) given I filed for my registered trademark back in 2010 (two years before Candy Crush Saga existed). Now, after quietly battling this trademark opposition for a year, I have learned that you now want to cancel my CandySwipe trademark so that I don’t have the right to use my own game’s name. You are able to do this because only within the last month you purchased the rights to a game named Candy Crusher (which is nothing like CandySwipe or even Candy Crush Saga).”
“Good for you, you win”, he said.


I can't believe the how little legislative common sense exists.

I am uninstalling Candy Crush Saga right now...

    Trademarks should be limited to the original filers only, and should be required to be refiled if the assets carrying the trademark come under new ownership.

    This is disgusting. Not sure why we have parent laws if this can happen. As with most things in a free capitalistic world, money can buy anything and the more money you have the more freedom you have to infringe on others freedoms.

    And this is why there are things such as cancer in the universe.  The problem with such manifestations is that they are ultimately indiscriminate, and karma doesn't always execute as one would hope.

    this is proof of whats wrong with trademark/patent systems in the US and not only that but with game companies in general these days.  If i was in this situation where i did release a game that i discovered was actually based on soemthing i did prior i'd let them keep what they have and find another name/concept whatever for myself, if not possible then i'd be working with that person and pay them royalties or something.
