I'll try to make this story as short as possible... Anyways, about a week ago I ordered Dead Space 2 from Amazon with release-date shipping. I also ordered something else, and both were supposed to be delivered on Tuesday. The other item was, but DS2 was not, so I decided to check the tracking number online. The tracking number in my Amazon account only showed that it had left their warehouse, while on the UPS website it stated that they had been notified and a label had been printed, but that they were still waiting to receive the item. I decided to contact Amazon because something was obviously wrong and they were extremely unhelpful. Starting with the online chat support, the guy told me that it could still arrive today, seeming to ignore the fact that UPS had absolutely no record of ever receiving the package, let alone any activity of arrival/departure scans in my area, or anywhere else. Once he finally realized the situation, he apologized and asked me to wait 3 more days and to contact them again if I didn't receive the item. I told him that this situation was extremely frustrating because I could just buy the game in person today had I not purchased it on Amazon. He then proceeded to tell me that I could still do that, and if the game arrived in a few days I could just ship it back and they would refund it. I asked if there was anything else he could do to help this situation (hoping for a gift card or something, at the very least) but he said no. So I decided to just give them a call. The lady on the phone was much more helpful and informed me that they could just send another game out that afternoon and I would have it the following day. However; she said that nothing else could be done to help rectify this situation (really, no gift card or anything?). I settled for the new game, as getting a refund was useless (I had a $60 Amazon credit, so I'd have to use it eventually). So guess what arrives in the mail yesterday? Two boxes from Amazon, each containing Dead Space 2, lol. My question now is what should I do? Should I contact Amazon about it and let them know? Normally I wouldn't hesitate to return it, but part of me feels like its a form of compensation, something their CS never offered. Do I have a legal obligation to return the second one?

If I were you I would call them up and tell them you got a second copy and send it back. It's the honest thing to do.

Here's another thing that makes me hesitant to inform them of the mistake: when I was talking to the first guy online who told me to wait 2-3 days for it to arrive (again, even though I ordered "guaranteed" release-date delivery) told me that it would be my responsibility to see that the game got shipped back, which would require a 15 minute trip to the nearest UPS office. I'm afraid if I call that they will ask me to do all of the legwork, when it was never my fault in the first place.

She made absolutely no mention about returning it should it arrive.

The right thing to do is call them, explain the situation and make them pay for any shipping necessary back to them. I would also have them arrange a UPS pickup, as it's not on your dime you have to drive it to a postal location to send it off. If they don't take care of it like that, then keep your prize. I did the same thing with Dell and evidently they felt it not necessary to have the extra monitor they sent me. I did my part and didn't hear back from them.

Actually, if you click on your account @ Amazon -- next to the item is a button to click for returning items... It pops up, enter a small bit of info and it then lets you print out a return label for the box. Stick it on there . Boom !

It's not Amazon's complete fault here, part of the reason you got two was that you were too impatient to wait and badgered them to send another. Dead Space 2 just came out on Tuesday, and you got the original one you ordered today (2 days late?). I guess I just don't see the issue. Just because the shipping came later than expected does not mean you get a free game.

I should've added that I just want to say good for you to the OP for actually discussing this and keeping an open mind! That has to say something about your character as some people would have just kept it without even considering doing the right thing. Good on ya OP!

There is no substitute for a clear conscience, no matter how you try to justify it. Knowing you did the right thing gives you that. Period. In the end, you choose the path you walk down, you can make it a path that's morally and ethically right, or... another path. It's what you can live with.

do nothing or call them. Tough choice. While under our Christian morality, I would say you should call them. Still, considering the ethics of modern business you shouldn't call. I would say call, keep it simple, if they want it sent back, ask that they deal with the shipping (paid label and pickup). Chances are they will say they don't want it back because they are making a claim with UPS. In which case you can sell it.

I maybe could, especially if I felt slighted by Amazon, but that is immaterial. For me it is about liability and karma. I don't want them looking for the money later and I don't want random bad things happening to me. I would call Amazon.

what the heck are you going to do with 2 games anyway? sell one? thats even more dishonest. you were too impatient when the dude said to wait a few days. you dont always have to try to stick it to the man. they did end up sending you out a replacement game anyway. i really dont see why you would be so offended just because you got nervous about the game being lost, which it wasnt.

Yeah, I was going to sell one to a friend. The only reason I was impatient was because I was frustrated that they were so unwilling to do anything to compensate me (the customer) for their mistake. I ordered guaranteed release-date delivery, and that didn't happen, so as a consumer I have every right to be upset. Anyways, I just contacted them and they scheduled a UPS pickup at my house within the next 2-5 days, so it's being shipped back to them.

Just gonna put this here since I'm sure you didn't take the time to read it. Amazon is not at fault here if they shipped as agreed upon (ship date is what? should show in tracking info) http://www.amazon.com/gp/help/customer/display.html?nodeId=200180350&#fine_print You will see that number 7 states "Does not apply in the event of service interruptions or failures (including, for example, interruptions of our transportation systems or the services provided by our carriers) caused by events beyond Amazon.com's control." Not being mean, but your impatience is the only thing that resulted in two copies being in your hands. You paid for one, the other needs to go back.
