so im posting this for advice from anyone with the same experience, and i would like to state evga support has been helping as much as they possibly can so thanks to them for that.
so i waited a year for my place in the queue for a 3080 ftw3 ultra gaming but unfortunatly had really low fps and we came to the conclusion it was defective so i contacted for help and they rma'd it for warrenty from germany.
after waiting a few days decided to track it to see where it was and found out i have to pay "custom charges" i spoke to parcelforce who didnt want to get involved and just said pay it and 4 different people at border force one person was trying to get me to claim back the vat on the old product and was trying to make me count the warrenty replacement as a "new product" and was saying new products have to have vat paid luckily i have my invoice from paypal stating ive paid vat and a email from evga stating its a "warrenty replacement", one person from hmrc was saying that the customs charges was "extra vat" / different vat and im not 100% guaranteed to get my money back even if i do a (bor286 form)and was laughing at the end of the call saying just pay it , totally not helpful, and the other 2 had no clue. then i phoned again not giving in to which one guy said if i had already paid vat on the point of purchase and i had proof it was a warrenty replacement i can 100% get my money back which evga support has said all along it just seems u get different information everytime u ring hmrc so its really confusing. the problem is im kinda worried as they keep saying "just pay it " but what if they decide to not give me the money back i cant afford another £150 ontop of what ive already paid is there anyone out there whos had this issue ?? PLEASE HELP sorry if this is confusing
