Z390 FTW boot error (5 beeps) w/ new 9900K

Well today I got my replacement 9900K from Newegg, installed everything back in mobo, and yes I cleared CMOS beforehand, always do and all went fine or so I thought. Upon boot I get 5  consecutive beeps and as is described here, it would appear to be bad CPU. There is only one way to install a CPU with the visual cues, socket etc. not sure other than it being bad according to the link above. Below is a video of my boot process:

my last 9900K I sent back to Amazon due to what I think is a bad or weak IMC but it did work.

    Take the cpu to a local pc shop to have it tested.

    Take the cpu to a local pc shop to have it tested.
    normally I would but not with the the current climate as it is, I've initiated a return to Newegg.

    Really, with 45,000,000 having had the Common Flue this year and 30,000 to 45,000 person who Died from that virus.  You were not fearful of that fatal virus, but fear of a virus infecting 1,700 with 42 deaths of persons with bad health over age 80.???  NY Times fear mongering (along with fake news outlets) stating as many as 214,000,000 could get the virus with 200,000 to 1,700,000 deaths is in my rational thinking just plain Stupid!!.  Following that thinking the world wide death toll would be 2.5 to 3.0 billion people and our Climate Change fears would End!  The earth's population would then be a sustainable 4.0 Billion.  Yea.   Just saying my crazy thinks go to these Fear Mongering Conclusions.

    anyhoo, with much thanks to EVGA's awesome support dept, I've narrowed what the issue is with the boot error and will report back in a few days to verify, suffice it to say, it's most likely not the cpu nor board throwing this error.
