In all honesty, I think that the moment you do have a pending order and they are selling out new inventory on new prices, definitely sure legal action would force them to deliver...
However, a sad story that is not doing you any good and not changing our situation today.. pfffft...

Because EVGA is sending buy links in order of queue times one can assume if we have 2 entries for successful buys everyone in between passed on their chance( IF the second entry is entered correctly of course)

Seems I can not link to anything. But if you open the spreadsheet at the top there is a link to the new website. PS. There are currently 12 3080 TI available in Finland for 2099 MSI GeForce RTX 3080 Ti GAMING X TRIO 12G verkkokauppa 3080 non TI I have been seeing some drops of random 3080 between 1500-1700 At this French website ldlc I am actually tempted at this stage to just get one and be done with it 1500 seems like a good deal at this stage..... At the moment of me posting they had MSI GeForce RTX 3080 GAMING Z TRIO 10G for 1600 Probably the cheapest you can find unless you live near a big store or have connections.

On a similar note to the ordering but not being delivered, there actually is a "queue" I signed up for locally, which is essentially the same thing but the price gets locked to when you entered... and I think it also does the "can't sell at a loss" part so my November "kind request to buy a 3070 for 570 eur" isn't going to be filled probably ever :( Xarfaks

Honestly, this price, considering the current situation, is probably the best price I have seen in a while. I personally wouldn't pay that much(and don't need the performance either :) ), but if you have the money to not care about paying that much and need/want the upgrade, go for it!

Honestly, I will probably go red if I have to overpay.... I can get a 6900XT for less than a 3080 non TI. (1800 Euros less if I get lucky and I can actually choose between several models.) Sure NVIDIA drivers are a lot better. And I like some of their tech like noise canceling etc. But honestly at this price and at this stage I am willing to show the middle finger to NVIDIA. What I want is either a 3090 or 3080 TI with a radiator as that would fit my case best. But honestly I am sick of this ****. I actually think at this stage we are down to pure speculation.
The initial mining boom and high demand drove prices up.
Now due to the fact that most shops dealers etc. do not deal directly with the manufacturers. We have too many links in the chain.
Whole sellers and traders have a large incentive to constrain supply to keep prices high.
This explains why we see prices calm down and get closer to MSRP at customer facing dealers that order directly from manufacturers.
It will take a long time before speculators will be willing to drop prices. It is often cheaper to keep this GPUs in storage and trickle them into the market keeping prices high.
This might lead to an actual discount somewhere around the second half of next year if they overestimate demand and hold on to too many GPUs.

AMD is definitely a valid option by now - drivers, to my knowledge, aren't exactly bad anymore, RDNA2 brought rasterization a lot closer to Nvidia... If you don't care about CUDA(read: the card is almost entirely for gaming(along with media etcetc) purposes), then it is a good choice. You will "miss out" on fancy RTX and DLSS(FSR coming very soon tho, seems very promising(albeit the quality reduction was somewhat noticable)), if you are gaming @1440p you more than likely won't have a major difference. :) Good luck :)

Actually the availability for the 3080 TI is pretty good. That one finish store is consonantly selling 3080 TI for 2100 since launch and they keep on getting new stock. Makes the whole price thing even more ridiculous also shows how speculation driven this is. Now I even see some 3080 TI popping up for 2000 in Germany. I might just buy a new case rebuild the whole system so that I can better fit a GPU without a radiator. Right now I am a bit stuck with EVGA as a AIO would really work best for my current build without any modifications.

Good Evening, here is the daily status for the EU queues.
As I prepared today's report I started to notice that the list has grown a bit since I took the job, 15 lines so far (we will ignore the 3080 Ti XC for now). It does feel like a journey, with recordings pilling up in tandem with the mileage. The funny thing is that I don't feel it anymore, it's something that is now natural, like those daily rituals that you really dont register anymore, it just happens and is part of you.
Ahem, anyway, after 2 days of silence the first 3080 Ti emails have gone out. These have covered 10 minutes of time on FTW3 air cooled SKU. No emails have been reported for the water cards.

I am delighted with EVGA. We have exactly 8 confirmed emails received. (Eight in a row on our spreadsheet with no gaps between rows). <-- For Europe 3080 Ti. That means our spreadsheet is spot on). (In other words, potentially almost every EU elite customer added themselves to our community-built queue tracker and everyone who received their email today updated their position.). It should now be much easier for Europeans to make an educated guess at when they will receive their own notification. (Based on their #queue_postion and how many daily emails EVGA sends). We'll get a better feel for daily email quantity over the coming days. Any Europeans who haven't registered for our 3080 Ti spreadsheet you are also very welcome on our discord server, for which Ayymoss set up especially for our queue. Thank you EVGA :- )

I refreshed 3070 ti product page for 45 minutes and only ever saw the 'site is over capacity' message. At this point I think I will just buy an APU and forget about all this BS.

Good Evening, here is the daily status for the EU queues.
The final Teapocalypse is behind us (tho tomorrow may have some residual server traffic as Elite restrictions are lifted). EVGA can now focus on getting the cards in the hands of the watchers.
I noted a small 4 minute move on the 3080 Ti FTW3 line, looking at Neutro's data we should be close to the end of the first group of signees. Let's see if Friday clears that first hurdle and leads us into the 7's.
