The problem is, the only way that person would get in trouble for it at all would be if the person that buys it reports to eVGA what the Serial Number on the card is & then eVGA bans whoever originally registered that card from ever being able to buy on their site again.  That's the worst thing that could happen to them.
Governments need to get with the times & pass legislation like they did for ticket scalping, for electronics, so that people can face serious consequences for this stuff.  I get that supply & demand is a thing, and people are willing to pay over market to get stuff NOW when things are in a shortage, but when things are selling for twice their actual MSRP, that's a little on the insane side imo.
I check the other day & 3080s are still nearly-insta-selling on EBay when sold as Buy It Now, for $1300-$1500, at least a few a day.  EBay literally doesn't care because they make money off things all the same, it's not their job to police such things.  eVGA can't really do a whole lot either other than ban anyone who's caught doing it from being able to purchase on the site again, and I don't know if they'll go that far.
I'm just glad they implemented the queue system, otherwise I'd still be waiting to even GET a 3080.  Hopefully they continue to use that when the Hybrid cards, 3070s and next generation comes out, so that people like us that actually buy the cards to USE them, have a legitimate chance to get one in at least somewhat of a timely manner.

People still sell tickets at a mark-up on websites like stubhub/ticketmaster. A great example would be you waited all night to purchase one great seat for a show and sold it last minute so you could afford to take your little brother along with you in semi decent seats).
Think about having to plan for a last minute flight somewhere the day before Christmas, surge pricing.

Electronic companies won't do anything neither would any company in any industry if they saw people fighting/paying above market for their items on third party sites it'll only increase demand due to FOMO or brand awareness compared to ASUS etc.
Look at other brands Apple Supreme Chanel and Hermes albeit fashion/designer handbags etc only increase in value over the years compared to electronics.
Some toys double/triple their MSRP too after you've missed out on purchasing it when it was available.

EVGA cards will become available to everyone who wants one eventually.

The govt does have laws against price gouging masks and hand sanitizers/lysol etc since its effects everyone's health.

Not sure of the point of another one of these threads.  There's zero recourse for EVGA if someone wants to purchase one of their products and sell if for a ridiculous markup. That is not illegal and it is pointless creating threads about something there is no solution to, period. There will always be folks with the available cash to pay whatever for whatever. Raging about it won't change it.

The problem is supply.  Based on how slowly cards are selling thru the queue.  And the retailers over in Europe.  The supply is just bad,  cards are in the 100s instead of the 1000s.  So it's a scalpers paradise.  Nvidia should of never launched unless they could of done a lot more.  EVGA still hasn't finished the first day of the queue yet

Called it. As we get closer to the holidays. The 3080 will go for $2,000-$3,000 people just laughed at me. They will see. This is so bad. It turned me off from buying another launch day card ever again. I don't think you guys realize the lengths people are going through to get these. Money wise. I have never seen something like this in all my years of gaming for a gpu.

Yeah it is getting pretty ridiculous now.
There is a Zotac Gaming 3090 listed on Amazon for just under 3K.
Crazy.

Not to sound like a price gouging ****bag, but that is what's going to happen, and part of me is looking forward to it, for the simple fact that I plan on purchasing a 3080 FTW3 Hybrid once they come out, and reselling my 3080... I might sell it locally at an actually reasonable price, if anyone in my area is looking for one and willing to pay for it in cash.
But yeah, even now EBay listings are slowly trending upward for both cards, and it WILL definitely get worse as the holidays get closer & people are trying to grab these for Christmas.
Blaming anyone but NVidia and scalpers for this is pointless though, NVidia not having enough supply is part of the problem, they should've waited & launched this next year so they'd at least have enough supply to actually saturate the market somewhat instead of having even small sites like those reported by Gamers Nexus having THOUSANDS of orders and only getting a little over a hundred cards in 2 weeks.

No big stock drops this week at all. Just some pathetic sprinklings of bundle deals on Newegg that my notifications never saw and were gone in seconds. I’m so tired of looking at this point. As for the EVGA queue, I’m slated for mid-January just to BUY the card. That means in-hand is likely February, or nearly FIVE MONTHS after “release”. Let that sink in.

It's not illegal.
It's not immoral.
It's an inconvenience to those who are spoiled. (I'm in this category.)
Tensions are high, and people are upset because they can't get what they want. Regardless of what anyone's profession is, the unobtainable nature of the cards isn't costing anyone their lives or health, aside from people letting it raise their blood pressure.
The Government needs to stay out of it. The real issue is self-control.
Oh, you wanted to go to a concert, but now tickets are ridiculous? Deal with it. There are people with life-threatening conditions that can't get affordable medications, because the Government got involved. (Looking at you, FDA.)
