So I just got scammed on eBay

I'm usually careful when using eBay, but this scammer got me. Here's how he did it.
 
I wanted to sell a Dell gift card on eBay since I wasn't going to use it. It was not a promotional card, it was a card with no expiry date. Someone purchased the gift card ($400) on eBay. It was supposed to be email delivery. I got paid and waited for the money to be safely deposited in my Paypal and transferred to my bank account. Once that was done, I sent him the card numbers.
 
The buyer then turned around and filed an "Unauthorized Transaction" report and canceled the transaction, claiming that their account had been accessed by someone else. Now he has the gift card numbers. My paypal balance now is negative $400 :(
 
He of course used the gift card already. Calling dell did not help as it was the weekend.

    This will difficult for you to get your money back but you should file paperwork with PayPal.

    I sent them screenshot of the message which sent over the gift card numbers. Anything else you suggest? I also took screenshots of the card balances after sending them over (but before they were spent) because I was suspicious of the sale. But I could not do anything because the arrow was already fired and the cards were already sent.

    Have you contacted the police department or the district attorney in the city where the buyer lives? That person committed fraud.
     
    Call Dell on Monday and report stolen gift card funds.

    Curious, what was the rating of the buyer? Not that this will help now but I always try to limit my auctions to only those with a certain amount of positive feedback.
     
    Like they've mentioned above, definitely file with Paypal and if Dell can possibly tell when that gift card was redeemed (date) that should be able to support your claim that the buyer committed fraud.
     
     Hearing that sort of thing happen really triggers me... Good luck and let us know how it turns out.

    Thanks for the advice, yeah will contact Dell on Mon and since I have one of those "legal subscription plans", might as well use it to get the lawyer to do something about it as I don't really have to pay them.

    The buyer rating was 572, with a 100% positive feedback. That's really what got me!

    wow 572 with 100% feedback...  With that it's possible someone did access his account and email..
     
    I know a business man whose email account was compromised. So there's a small possibility that's what happened. 
     
    In that case, I think Paypal should cover the loss both ways however.

    I looked into this. Apparently buyers can only get positive feedback (or no feedback). The account had no sales at all, and purchases were all masked and from people easy to target for scams (mostly accounts that auto-leave feedback one payment is received). So it all adds up really.

    You have his address, Since he purchased you should have received his address. I say $400 is enough to warrant a visit. He can keep the money, Just make sure he knows not to do it again, ya know? ;)

    haha, he lives in a different state. Besides, I'm definitely not inclined to something like that considering how trigger happy people seem to be these days.

    Depending on where he lives this could be a felony. Being it was online and goes across state borders it might even be federal, depending on the laws. At the very least it sounds like a person who knows what they are doing , have done it before and law enforcement may be waiting for more to step forward to investigate them further. Even if it doesn't go your way, you lost your money etc.... reporting it and them sets them up to receive that karma back eventually, once they've done enough stupid things to get caught. :)

    If you have proper documentation the PayPal will back you up. If not the eBay will. You should be able to get your funds back. Just don’t give up if they say no at first.

    I don't doubt that ultimately you will be credited for your loss if the scam happened just the way you have described. But I am curious about something. You wrote "I got paid and waited for the money to be safely deposited in my Paypal and transferred to my bank account. Once that was done, I sent him the card numbers." If you don't mind me asking, how long did this process ultimately take? Cause I'm unsure if you meant using a Paypal debit card to withdraw the money or actually transferring it to a bank account. Cause I didn't think any banks transferred from Paypal on the weekend. Did the sale happen on the weekend or the filed claim?
     
    One last question, on the Ebay sale, did you state there would be no refunds and only after payment had cleared and funds available to your bank would you release the numbers for the card?
     
    I'm not an attorney and I don't work for Ebay or anything, but I too have experienced scammers in the past and want to see you get this situation straightened out as fast as possible.

    I initiated the transfer to the bank account successfully, which means my paypal balance is zero. But the money still has not shown up in the account. But I don't doubt that it will since the paypal balance currently shows negative and I don't think paypal will stop the transfre mid-way. On the listing I clearly said "No refunds" but nothing about clearing the funds. That's because at the time of posting I really wasn't thinking I would be scammed.
     
    On a side note, I really appreciate the community on this and the suggestions, some have been pretty helpful. Thanks guys.

    Next time send the card by USPS, then if they scam you, I would think there is mail fraud involved too.
    Use tracking so there is proof it was delivered.

    Sucks that happened to you. But definitely take screenshots of the transactions, etc. and send to paypal and Ebay. In my experience as a seller if you have proof, they will make you whole.

    Doesn't really say anything. It just seems a temporary thing I guess awaiting more documents from the scammer. I don't understand this since I really sent them screenshots of all the communications etc, and they still side with the buyer. That's pretty crazy - not to mention the "Seller Protection" is a joke. My sales were indicated as being eligible for seller protection. Of course that did not help.

    Sad to hear about the scam and hope you get some or all of the lost money back. As for recommending hurting the scammer or damaging his property it wouldn't be a good idea. If you do then you will probably end up in jail or prison. At best the scammer will also get in trouble but for $400 it could just end up with a fine and probation.

    It's the only way people learn. I say this by experience (No I never stole anything or scammed anyone, But in general).

    Honestly, eBay used to be really good but now its kinda sketchy. I wouldn't recommend using it to sell stuff. Just seems like Amazon is a lot better with this stuff.
