Why are you posting a duplicate thread in the wrong section of the forum?
My opinion is that EVGA has made up its mind, and EVGA's decision is justified per the terms of the warranty. It's a sneaky way to get out of replacing your video card, yes, but that's just how it goes. You haven't been the first who has been denied warranty for seemingly unrelated damage. Damage is damage. It's chipped, worn, and corroded. That voids the warranty.
