Problems with GTX 1080 SC2 iCX, from amazon.

Hey,
 
So basically i got the EVGA 1080 SC2 from amazon today, the packaging box was kinda messed up, the GPU's package was okay, but the tape was opened and inside the box i got everything but the adapter PSU thingy bag was OPENED, maybe post mail checked it or it's used i don't know.
And there was no protective sticker on the front (fans side) of the card, i bought it from amazon not a 3rd party seller.
 
So when i tried to play bf1, overwatch, and cod ww2 the fans started making a coil whine sound, the temp was normal, cpu usage normal, got latest drivers and XOC.
And bf1 had low fps 40-60 fps but i kinda fixed that in settings, now it's 90 fps+ better but the screen is not strong enough for the gpu i think, it stutters even when i limited the FPS to 60....
 
Also my cpu probably bottlenecks the GPU with 20%, 
And it almost gets to 100% usage sometimes, if i play above 60fps.
 
My specs:
 
CPU: i5 3570k 3.4ghz
GPU: GTX 1080 SC2
Ram: Corsair 8GB ddr3
OS: Windows 7 ultimate 64bit
SSD:  sata 3 crucial 512GB
PSU: Seasonic 650w gold modular.
 
My EVGA gtx 760 SC was silent. 
Basically the bigger problem is the coil whine, can the card be used or refurbished? or some luck of the draw bs?

My psu is good enough for the GPU i believe.
 It's powered up by a single 8pin psu connector, and it only came with 1 dongle, and i can't find details on what should be inside the box! 1 dongle is everything or there supposed to be more?
 
So should i contact amazon or EVGA first?

    Contact Amazon, explain your concerns, and ask for a replacement. Amazon is the company to deal with this close to purchase, not EVGA.

    Btw i see that you have a 3rd generation intel CPU just like me (if the signature is updated), how does it perform with your 1080?

    Well, I am not sure about my opinion of my CPU. It seems very capable and I don't have complaints, but I don't have much to compare against. Of the games I play, I haven't noticed any obvious CPU bottlenecking or other performance issues.

    Well i have bad luck all the time, instead of replacing the card and waiting and waiting and probably getting the same problem, forcing to waste money on a new rig, i think that i'll just refund it, bought it because of the stupid copy paste unoptimized Cod WW2.
    I guess i'll make more money and wait for the volta series....
