RTX 3080 FTW3 Ultra Fan spikes in Anno 1800

I have started expeirencing weird fan issues when playing Anno 1800, Im guessing this is the same sort of issue people have been experiencing with New World.
 
Has there been an official word from EVGA on this issue or are we still in the dark?
 
Along with the fan spikes comes a nasty electrical crackling sound from the GPU, is my card going to die? Is there anything I can do to fix this myself of am I going to have to go down the RMA route?

    Thanks yeah I have done that, waiting to hear back.
     
    Interesting new development, it only occurs in DX12, I switched to DX11 and the fan problem doesnt occur.

    Scratch that, it still happens, just not as frequently in DX11
