x79 FTW - Slot 1 PCIe only showing as 4x

Board - x79 FTW
CPU - 3930k
 
So i have 2 PCIe devices in total
 
One Zotac GTX 970 4GB, in the top lane (set in bios to PCIE3 x16 (with nvidia's force 3.0 tool in OS)) that displays 3.0 but only 4x
and one 1x wireless card in slot 6 Gen 2
All other slots are disabled by switch on the board.
 
No matter what i do, which BIOS version i use, i only seem to be getting 4x from that top slot, it shows 4x in BIOS and also shows 4x in GPUz
 
I've tried just about everything i can think of here and cant figure out why its doing this and want my card to be using the 16x it supports

    Could be a problem with the card, top pci-e slot, or cpu pins. Recommendations...
     
    #1 Reseat the cpu, and check for bent pins in the socket while you're at it.
    #2 Try the card in a different pci-e slot.
    #3 Test the card in another pc to see if it's still stuck at x4.

    #1 been done a couple times, no difference
    #2 in slot 3 i get x8 as that is all that slot can deliver, better than x4 but now i also have no use of my case audio headers as the connector is completely obstructed
    #3 card works fine at x16 3.0 in other systems.

    Try running the card in slot #5. Move your wireless card to another slot.

    Perhaps shutting down the unused pci lanes with the switches is making them unavailable for any device. If nothing is occupying that slot, should not have to disable it. How are you testing the speed? Here is the Dark X79 lane distribution: Almost the same as the FTW only #2 in 1X. If I remember right 30 lanes are available on X79 boards. Both boards have 5 full length slots with 2 of them 16X if other shared slots are empty.
