3080 FTW3 BSOD

Recently got  a 3080 FTW3 about 2-3 weeks ago but I'm having BSOD every time I restart/cold boot. It will BSOD then reload bios again and then go normal afterwards but now whenever I play games I'm starting to get stutters and freezes. I didn't have any issues before when I had my EVGA 2080 ti ftw3. I have already tried to DDU my drivers.
 
This the error i get when it BSOD'S : nvlddmkm.sys

    Download DDR and use it to remove the GPU drivers.
     
    Download and reinstall the GPU drivers.

    There have been a lot of compatibility BIOS updates for your motherboard. Are you running the latest? https://www.msi.com/Motherboard/support/MEG-X570-ACE

    Yes I updated to latest bios.

    Remove any overclocks and test again (CPU, RAM (XMP or AMD's equivalent is an overclock), GPU).

    I don't have xmp, boost clock or precision overclocks. still does the same thing

    Fresh windows install, or test the card in a friend's PC or at a repair shop. 
     
    Other than that, I'm out of ideas other than to RMA.

    I might just send it to rma since my 2080ti and 970 don't give me BSOD and just boot normally.
