1070 FTW RMA Eligibility???

Hello! 

I recently JUST purchased (yesterday actually) a 1070 FTW from Newegg, only to find out that my card has been having problems with heat and such. Unfortunately, Newegg has my specific card as "non-refundable"; only "replaceable". I believe that when a defect this large occurs, EVGA should recall all of their affected cards from retailers in order to not have people like me buy a seemingly defective card while under the impression that it should work perfectly.
 
If EVGA is trying to fix this issue, ANY affected cards they have should henceforth be manufactured with the thermal pads installed and not require the customer to have to install it themselves... Even after the new VBIOS has been installed by EVGA.
 
Given my bad luck, is there a way I can have my card cross-shipped to EVGA for one that has the new VBIOS and thermal pads installed?

    That's why you should research any product you are going to buy before hand.

    I would search here for the other answers yuo are asking because they have a ready been anwered.
