No, that's a dog falling asleep, then suddenly waking up from the water hitting his face.
why is the dog in such a place that if hes that tired he cant go to dry land by instinct and sleep?
maybe the dog is trying to bite something in the water, a fish?
I think Hething is right. I think he was trying to catch a fish with his mouth. I'm glad that mystery is finally solved, and Nex can now feel at ease. :)

See Nex I told you he was falling asleep. Problem solved, and there is no more reason to think that dog was inhumanely treated or anything like that. Thanks to RC for clarifying it. 
my lab has done this, run himself ragged and just fall over. he gets so wound up and is to stupid to stop when he tired. i have a nitro R/C car he will chase around the yard until he passes out or his paws start bleeding and i have to stop him. twice hes worn the pads right off his paws and i had to tape him up and lay him down for 2 days until he healed.
