Gigabyte warranty goes off of S/N - so you should be able to RMA it that way unless there is damage. Otherwise I don't see it being able to be repaired by a BIOS update - or baking for that matter... TBH baking doesn't fix anything.
wrong, ive fixed many a cards with a good old fashioned bake, a 9800GX2, a GTX 285, a GTX 275, an 8800GTX, 8800GTS, and 8500GT all fixed @ 385F for 10 minutes
