I also have this issue but to my knowledge EVGA are not accepting that this is affecting GTX 1070 cards, have you come across a statement or proof saying that they have accepted it is affecting 1070's as well? It would be appreciated if you do as i am currently in a RMA with the retailer to request an Asus 1070

My RMA because the overheating and black screens on my 1070ftw got approved and they also released new BIOS for their 1070. So thats proof enough i think.
I think EVGA is doing now good work with thermal pads + bios. Other Manufacturer would just sit it out.

I got my RMA today, it was definitely a refurbished GTX 1080 FTW. I can see a couple of small scratches on the top of the card where the logo is. I noticed the card ran a little hotter than my first card. Hopeufully there are no issues with it. To early to tell.




My replacement card is also scratched somehow when I got it out the box and has worse overclock-ability. I don't really care though because it actually works. Scratch can be seen on the bottom part of this pic that I took when I inspected the card when it arrived.

The plane mission in BF1 is not a good benchmark for this as that mission causes stutters on nearly every system. It may also be linked to the nvidia-driver you are using.

  I updated my 1080 FTW card because it was very hot when playing BF1 but now I am getting black screens when I try to reboot.
 
 I just put in a Support ticket but what are they going to do?   Do they have another flash that is going to work for my card?  I tried using the flash they posted a bunch of times but I keep getting Black Screens.

I also received a used card less than 2 weeks after purchasing my FTW brand new from Amazon. It was scratch similar to yours, but much worse, and also had damage to the back plate.
 
I would not accept this 'solution' to the QC problem that is clearly plaguing EVGA for this cycle. I switched to Gigabyte for my purchases and the 1080 Extreme Premium Pack was a great deal and I have not had a single crash, lockup, or other issue in the many weeks since.
