cmos checksum error - x99 micro

Have had checksum errors since first boot. Updated bios. Ver: E995 114
Pci-e slot 1 doesn't function properly in windows (code 43) but in bios works fine. I have gfx in slot 2 (8x only with my cpu)
Name a solution, I've probably tried them all by now with help from a friend. He says RMA at this point. Maybe I need a new bios chip ? No idea.. Brand new everything from Friday (1/16/15)

samsung 850 pro
evga 970 (04G-2974-KR)
H110 water.
Windows 8.1

    Is the CR2032 battery that supplies power to retain the bios settings in properly? It sits between slots 1 and 2 on the x99 micro board.

    It appears to be. Settings stay saved too, and reset works. For some reason the error isn't showing anymore. I think maybe windows is causing the slot 1 issue. I'll do a reinstall
     
    update: problem persists but I think the bios is ok since I'm not seeing any error anymore. Think I have to start a different thread.
