You guys realize this is gonna be just like with intel where they push whatever happens to them off on to the consumer to pay for. So lets say you get your 100 bux from NVidia, well you can be darn tootin sure that everyone will be paying 200 extra on subsequent cards forever. Even after the judgement is paid youll still be paying it because NVidia will figure everyones used to paying that extra now so lets keep it and bank it. Arent prices high enough?!?!?

Seems to only be an allocation bug, Driver update should be able to fix Direct3D

If customers think to react with court must consult someone with similar experience first.
That's playing with words.
Did NVIDIA clearly say GTX970 is absolutely 100% same with 980?
Did someone ask about 4GB memory allocation? 
They could say Card have 4GB, but games use only 3.5GB.
We didn't lie, nobody ask and NVIDIA think it's better for comparison with R9-290X and GTX780 if they
stay silent and customers think only difference is 500 CUDA, but nobody ask nothing.
All reviews must be looked, all official statements, I'm not on NVIDIA side, I'm customers too, their, but only try to explain best I can what can happen on court. You know there it's easy to culprit become victim and customers to pay court later and NVIDIA even to ask something because negative publicity. 
How many times criminals get out of prison because good layers or because raining that morning.
 
Or could finish on this way... To court say NVIDIA should better inform customers next time but because much lower price than GTX980 court think it's fair deal. They should write on box Games use only 3.5GB, 500MB for other purpose and The End, nobody is guilty and nobody get nothing... except court and lawyers someone must pay taxes and etc...

I read lot of people ask compensation and some free games and NVIDIA to fix situation.
It would be excellent if NVIDIA fix with next drivers special because customers with SLI and no need for some compensation for 2-3 weeks problems if situation is fixed. I would really like if customers could use their cards properly without performance drop and I would think only on that, nothing else.

The problem is that all people thought they are buying a real 4GB card and if needed they can use all its memory in full speed. The truth is, the 0.5GB is actually useless because once the 3.5GB is full, game start to stutter - so it is the same as if the game would start accessing RAM. Ok, maybe a bit better but still unusable for smooth playing. Check my comment here:

Yes it is, but useless. Once reached, the game starts stutter until it drops bellow 3.5GB. We all were buying a 4GB with constant memory speed. This was hidden from us and this is unfair trade practice. What will be the next ?

The .5gb is known to be slower for now and they are working on a driver update to patch the issue. Hold your horses and calm down.

Now, when you run over the 3.5gb, you get slower fps and stuttering, but you don't get it like you would if it completely ran out of vram. It buffers the .5gb of information and once it gets back to 3.5gb, everything runs smooth. Just like anything that buffers on the Internet. Have you ever had a video buffer on high speed Internet? You pay for 100mb/s connection, but your buffering a video that is downloading at 10mb/s and still buffering.. I don't see people in an outrage over that. Twitch is a good example, max bit rate of 3.5mb/s yet it buffers for people with stellar connections. Where is the outrage?

Consider this, if my card hit the 3gb of vram wall, it would be unplayable, not stuttering.. 8-15 fps, not in the mid 40s with some Stutter. So your card is outperforming mine, and that is a problem...?

Nvidia has said they are going to work on the proper utilization of the driver, so we'll see.

This is all very interesting, but until Nvidia comes out and outright says what they're going to do, a threat of lawsuit is knee jerk. Despite not being affected by this (as I own a 980), I am still upset that there was a miscommunication or a failure to communicate the segmentation and disabled L2 cache. Regardless, only time will tell what nvidia will do, but whatever it is they need to make the decision fast. AMD already made a Sony @ E3 tier joke.

What they can say, same as MSI and GIGABYTE, it's not their fault.
Similar situation would be, but not same if Intel let people to think that difference between 5820K and 5930K is only 200MHz.
And when they connect two cards they work on x8, only with Intel that's obvious specification with GTX970 situation is little unusual and people couldn't know on any way, they didn't had similar situation before.
