I think I'm just gonna rma my card I bought in November for a refund then buy a 960. Saves me $150 dollars too and I don't have to deal with all this crap anymore.
But you'd still be supporting the company that you claim lied to you...

The world is full of people who try to take advantage of the situation.  If you truly are upset with the 970, most e-tailors are giving full refunds.  Newegg took my card back after 2 months of use, and I saved $150 and got an AMD card that will hold me over until the next gen cards come out.  I don't agree with how Nvidia dealt with the situation, so I took my money to the other team for now.  The 970 is still an amazing card, I mostly switched based on principle.

He has a good idea though. He could get almost 2 960's for the price of one 970. That would mean 1/2 the memory, littlw to no games over 1080p and much lower resale value, but it definitely is a good idea.

Today all companies lie more or less, I mean that's not real lies but...
And AMD do that only on different way. 
NVIDIA made huge mistake when ignore to clear situation fast and offer upgrade to GTX980 to first 100-200 people who bought GTX970 before problem is recognized.
Today we would listen only sad customers who didn't bought GTX970 on beginning before NVIDIA explain how memory on GTX970, because they didn't get chance for upgrade.
