Do you have this issue in another game, for example, if you fire up any shooter game, remap jump to right click, hold down left click and try to jump, see if the issue is repeated outside of D3.
I suggest this I have seen button mapping as well as macros from other brands of mice that would have issues only within certain games/engines.

Leoman77, have you had a chance to try my suggestions?  Also, I left you a voicemail to see if we can get this handled asap.
If this is strictly a Diablo 3 issue there are certain skills that will take precedence over others, for example, with a Wizard, personally I use Chain Lightening (generator spell) left click, and Arcane Torrent (mana spender) Right click, I can hold the trigger on Arcane Torrent until I run out of mana, if at any time I tap or hold left click Arcane Torrent stops and Chain Lightening starts as it is a spell that seems to be prioritized, and as long as I hold down left click, right will NOT work.  This is due to how the games spell mechanics work.
 
If this is the issue, there is no work around, if not, please let me know some details and I will assist, also as I suggested before, please test in a different game.  Lastly after you hit 10 posts you can PM me, you can also email me directly at DaveB@evga.com as well.

My mouse better not do this or it's going straight back for a refund. 

I'm pretty sure the mouse works but just not in Diablo 3... a quirk in the game perhaps.  Here's a thread by the OP asking for a macro for said mouse button in Diablo 3:

I hate to resurrect a dead thread from years ago but I recently encountered this problem and I believe it is a design flaw caused by the removable cover.
 
If you hold right click down with a good amount pressure and inadvertently slide the top cover back or forth, it can cause the left click to get stuck...
 
This may cause me to return my mouse and look for something else. I am still a big eVGA fan but I don't like the frustration caused by this particular product.
