From the in depth FAQ: https://www.gtx970settlement.com/Faqs.aspx

    6. Am I eligible to receive a Cash Payment for a GTX 970 that I received as a gift (i.e., did not personally purchase)?
Only the person or entity that actually purchased the GTX 970 Unit directly from the Defendants, the AIC Partners or their authorized retailers between September 1, 2014 and August 24, 2016 may submit a Claim Form and be eligible to receive a Cash Payment, subject to any other eligibility requirements.

    7. Am I eligible to receive a Cash for a GTX 970 that I purchased second-hand or from someone other than the Defendants, the AIC Partners or their authorized retailers?
Only persons or entities who are the original purchasers of a GTX 970 Unit that was purchased directly from the Defendants, the AIC Partners or their authorized retailers between September 1, 2014 and August 24, 2016 may submit a Claim Form and be eligible to receive a Cash Payment, subject to any other eligibility requirements.

Both of those show only the original purchaser may receive the refund. Now people will still ask without needing to.

Why can't there be a copy of this open in the 900 series forum again? In my opinion, for something this important locking that thread without making it a sticky is more of a sleaze move that will only hurt folks who have a 970.

It's not like the option for a refund isn't closing down after 30 November, so sticky it in the 900 series forum until then so that the people who were duped can get some of their money back.

more information maybe? Either way, they can still read through that thread, and click on the link to here for further information. It's not really hurting much, I would think.

Except that it will drop off the first page in short order, and those visiting the 900 series forum very well might not go to the second page to see it.

Possibly, however you can still review that thread which was closed, and you can still see the link which the original OP posted, and the link which Xrayman posted when he closed the thread, is directed to here. It's still a win/win for all.

    NATURE OF THE SETTLEMENT

This lawsuit claimed that Defendants sold GeForce GTX 970 graphics processing units to consumers based on inaccurate or misleading information regarding the GTX 970's specifications, performance, and capabilities. Defendants deny that they did anything wrong. The Court has not made any ruling on the factual allegations in the lawsuit. For more information regarding the litigation, you can download a copy of the Settlement Agreement and Long-Form Notice by clicking on the document below.

Not sure if someone on here knows or I should contact evga directly, but I have a question. I had originally bought a 970 ftw from newegg, but then used the evga step-up program to upgrade to a 970 ftw+. Which one should I use to claim on the 970settlements site?

The original 970 that you have an invoice for. I also stepped up my 970 FTWs to FTW+s and used my original 970 FTWs since they are the ones I have invoices/proof of purchase for.

I think that makes you ineligible.

I originally bought a 970 and due to it starting to act like it was going to take a crap. I updated to a 980 ti Hybrid before my time to upgrade was up. Am I eligible ?

If you at any point purchased a new 970 outright from NVIDIA or one of NVIDIA's partners or authorized retailers and have an invoice for that purchase, you should be eligible for the reimbursement claim.  If you step up to a 970, I do not believe that you are illegible.  If you stepped up from a 970, you should still be illegible.  Even if you sold your 970, you should still be illegible.  Basically, at some point, you need to have bought a new 970 completely (not a step up) and have proof that you did.
