Mouse driver not loading on boot or reboot? (occasionally)

Windows 8.1 latest updates etc... EVGA Z68 FTW mobo... Version 1.60 Torx software... Malware/virus free system.
Occasionally no mouse on boot or a reboot. Have to unplug and plug it back in to make it work.
I have tried: Different USB port, Removed Torx drivers (and cleaned)/reinstalled, updated intel chipset drivers v10.0.13, checked cable for a short/wriggled it a bit...
Shall I RMA this or is there something else I can try? Suggestions?

    I have the same issue more so if I Over Overclock my CPU. I unplug the USB Cable wait for the Windows Hardware Sound chime and then plug back in the USB Cable. I do NOT use EVGA Mouse Software. I do install it only to update the Firmware on the Mouse and then remove it.

    I would contact support and push for free EAR service like we have seen them do for other Torqx customers. If they won't do it you know which brand to avoid when you need a new mouse. Logitech covers shipping both ways on all RMA's.
