GTX980 Superclocked ACX 2.0 - Loud Fan / Throttling Problem

Just picked up this card, and when I power it up one of the fans runs at full speed constantly.  The second fan spins up at power on, but shortly after it shuts off.
 
Seems like a bios / performance profile issue but I can't get it to change states ever with the precision utility.
 
Any suggestions or update information would be appreciated.

    Have you tried to reseating the video card? Have you tried re-installing precision?

    I moved the card to another PC and had the same results.  The fan closest to the bracket / video out ports just constantly runs at full speed.
     
    I installed precision on the second system, and it appears that if I try to adjust the fan speed, it does adjust the speed for the other fan on the back end of the card.  There is no change to the fan over the gpu though.

    I also would like to report that the card seems to function properly, I installed Windows, drivers, etc.  Installed Unigine Heaven benchmark and everything runs fine.
     
    Temps reported to stop around 58c.  GPU fan still running at full speed, secondary fan over PWM is not turning on, presumably because the card is not getting hot enough.

    Just going to RMA this thing to Amazon, not getting much help with this card...
