Users considering pursuing a class-action against Microsoft must keep in mind that they agreed to the EULA while installing the new OS. After upgrading to Windows 10 via ‘automatic updates’ thousands of the PCs have “been rendered useless,” and left with 1. no sound, 2. no operating screen time 3. no access (password issues) 4. memory issues 5. lost files 6. unauthorized access by Microsoft.”        Link

    Regardless of the EULA some state laws may circumvent this.

    Im so sick of Windows 10 trying to forcibly install on my Win 7 desktop. The fact that they are pushing it so hard on users has me asking questions.

    Yeah, but Agent, all the other apps out there do it so you shouldn't care. Your just paranoid man, so what if the WHOLE OS is doing it. Only criminals and terrorists have something to hide man, is that what you are?!? :P  LMAO, Im just messing with ya. :)  You know I feel the same way you do about 10 and def am sick to death of hearing about how your a criminal cause you want your privacy and don't want to be hacked, subjected to id theft, stalked, scammed, or just prayed on in general. You don't know what data they are REALLY taking and where all this data truly ends up, or whos hands it ends up in ,and that is a scary thought. Microsoft does not need to auto grab data about you, your pc and your habits day in and day out under the guise of revenue... that's ridiculous. If its purely for crash purposes and to improve the OS then the crash reports that are generated should be voluntarily sent to them if its necessary, like in every other OS they've made. Some people crash their rigs on purpose for testing, sometimes it crashes cause of something you did and you know how to reverse it etc... so not every report needs to be sent..... IF you want to send it. So obviously its not just for that!!! Its one thing when a application does this, but when the whole os is doing this its a tragedy. Then they keep renaming the files, probably adding more too, so you can never truly root everything out and on top of all that one of the MS chiefs comes out and says their is no way to stop them from collecting data, short of unplugging your internet. Well, yeah, if your gonna keep changing everything and adding hidden things etc.... every month with updates, which you cant get away from, well never catch all the crap you put in there. I would be willing to bet that when you do turn off things that they ALLOW you to turn off or use outside apps to block the stuff, they probably default to some of the main os programs to send the data anyway. I cant imagine what and how many backdoors that OS has and how much the "research grant" was that encouraged MS to put them there and then to make sure everyones moved to it, by giving it away for free. The whole thing is a disgusting example of the billionaire mind set and the corporate greed that has run amuck over the whole world.

    I would be willing to bet that when you do turn off things that they ALLOW you to turn off or use outside apps to block the stuff, they probably default to some of the main os programs to send the data anyway.

    I will refer you to this article here. It is EXACTLY that. Even when turning off the settings it still sends data to Microsoft.

    Class action suits are a scam. The lawyers make most of the settlement.

    True but I got about $1000 one time for a class action lawsuit with my work for something I had nothing to do with. Just the other day I got a check for 10 bucks (or a 25$ voucher) from a class action lawsuit involving Burlington Coat Factory  http://topclassactions.com/lawsuit-settlements/open-lawsuit-settlements/244848-burlington-coat-factory-class-action-settlement/
     
    I'm sure the lawyers got their cut but I look at it as free money.
     
    I just want Microsoft to come back down to earth. Data collection for improving future releases is one thing but agreeing to let them use my info, including emails and said contents in any way they want is steaming piles of fudge dragons. Collecting data when I tell it not to or upgrading when I tell it not to is also brown trout with peanut eyes and corn teeth. The only reason a Monopoly exists is because the people let them, I don't want that to be the case with Microsuck.

    Maybe MS will listen, not all of us like being bullied!
     
    I saw this lawsuit coming months ago. Even if the suits get most of the cash,  MS has way too much control, and I see very little difference with said suits earning their paycheck vs fanboyz....

    There won't be a lawsuit (I don't think) as Microsoft has pretty much covered themselves with the EULA agreement.

    EULA does not protect them from wrongdoing. Contracts and agreements are invalid if they include illegal subject matter or illegal activities. For instance, slavery is illegal...so if Microsoft in their EULA added at the very end ".....and from this day forward you are now our slave and must make us waffles everyday"......that would not hold up in court, EVEN if you agreed to it.

    You cannot sign away your rights in a EULA. EULA contain certain limits on what can and cannot be forfeited by your agreement to the terms.

    They can use the contents of your email in pretty much any way they see fit, they can remove whatever programs they feel are not of their liking , legit or not.... Waffles is not that far off.

    I dont see public schools, colleges, universities and fortune 500 embracing Win10 and Microsoft's overreach...
     
    Just not an overreach, but were expected to have 100% faith in Microsoft's security on our desktops, when XBox_live services have been hacked how many times past 12months.

    Regardless of the lawyers getting the lions share, I think this needs to be done (and I HATE Class Action Lawsuits)...

    Microsoft has overreached itself.
