Retailers will only go so far to make foolish customers happy. The fact that they know you are just trolling for a refund and are not "damaged" is the main issue. Many may have been more timely and got a refund, but it seems that door is closing or has already closed. The time has come to accept that there is no merit to these claims. No retailer has a policy to give you back 10% of your purchase because you complain. If you purchase many things and are a high volume buyer, then they have the discretion, but this is only a few who actually qualify. Most retailers do not make 10%, so no one will just give their profit for no reason. Again, sell the card and buy something else. Even a bad review at this point looks tainted. Haters gotta hate.

Purchased a 3975-KR from Newegg this morning, contacted them through Newegg chat and asked them about this $70 refund.. was told no refund, credit etc of any kind is coming my way.
With the class-action lawsuit, the only thing I see them doing is offering you a chance to upgrade to 980.. in the end, Nvidia wins out as they will see a slight increase in 980 sales. Maybe they knew this beforehand, a business strategy.

Thats probably because you bought it today and I bought mine in November before I knew (or the public knew) about all this crap...

How presumptuos (if that were the case, I would have asked before the purchase, yes) but, I read this post after the $10rebate print-form led me here, "after" purchasing the GTX, and that does not constitute people trying to get over, not everyone knows about the VRAM issue

Got a 100 percent refund ( didn't keep the card ) today from my retailer where I purchased it from 4 months ago. The sales person said the card was defective from the manufacturer. I decided to try after reading where people were getting full refunds from retailers. My friend was offered a full refund on a gift card from newegg last night. He told the rep, that wasn't acceptable and wanted cash. After some complaining, newegg will give him a full refund once they get the card back. And they paid for shipping. I really think the way newegg is doing this, is based on how much a person spends in a time limit. He just spent 600 dollars a couple of weeks ago on some hardware. Hope it works out for you guys who's thinking about returning your cards.

The thing that I noticed after talking to the different representatives was that they don't seem to communicate.  The first time I asked it was immediately 10% where all I said was GTX 970, the second person I talked to offered me a full refund and I had to wait 10minutes for them to "contact" the other representative about the 10% discount.  So it seems that some of the staff on Newegg is not aware of the rebate likely because they have different field offices and you just need to tell them that a representative told your friend about it and your friend got it. then they will try to figure it out.  If I had to guess there probably disorganized about the "policy" of a 10% discount and some agents may not be aware of the "policy" based on which field office you contact with in their online chat rooms.

Just so everyone is aware, once you get any cash back, partial refund, gift card, store credit, or any other type of payment, it is a legal settlement and you have no legal right to complain about the issue again at any time in the future.  Enjoy your cards!


 
I'm curious where you got this information because in my business this is not the case. I'm not a lawyer but I do work in customer retention so policies like this are familiar to me. A simple full or partial refund from a retailer does not disqualify a customer from further remedy from the manufacturer. Now the retailer can protect itself by having a legal agreement attached to the refund but that would only go to protecting the retailer(Newegg), not the manufacturer(Nvidia). There also could be no room for error on this and the retailer would have clear guidelines for the customer service representatives to follow. Any discrimination, i.e. refusals, would work against an agreement like this. With the amount of variance we are seeing in these refund reports this is simply Newegg providing good customer service. Besides most reports are dealing with someone in a chat window and from my experience dealing with both Newegg and Amazon online chat there's no way to have a legal binding agreement in that form.
