Restocking fee apply?

In light of the latest scandal of Nvidia and the 3.5 GB issue, I am contemplating returning my GTX 970 SSC 3975 card I purchased a week ago directly from EVGA. I do not have $200 lying around to step-up to a 980, but I do not want to be hit by a 15% restocking fee either. Will I still be hit by the restocking fee if I decide to return the card?

    Scandal is a bit of a misnomer, but you get my drift.
