Which games are you playing?  Those that are single-threaded will likely run better on the 4790, but those that are (largely) multi-threaded should run better on the 5820.

Toms Hardware looked at a few games in their review, and came up with the following:
    •  Battlefield 4: 5820
    • Grid 2, Metro Last Light, Thief: 5820 (but very close)
    • Tomb Raider, World of Warcraft: 4790 (but very close)

Current PC: Intel Core i7 4790K, Noctua NH-U12S, Asus Z97-Pro, 16GB Corsair Vengeance Pro 1866Mhz RAM, Samsung 850 Pro 256GB, Crucial MX100 512GB, Western Digital Black 2TB, EVGA GTX 970 SC (blower), Pioneer BDR-209DBK, Fractal Design Define R4 + Noctua NF-A14 FLX fans, Corsair AX760 PSU, Dell U2713HM

Honestly, unless you absolutely need the extra 10% performance boost I wouldn't bother imo
I'd just oc the 3770k to 4-4.5ghz and call it a day.

Finally , I am planning to buy I7 4790K and to not oc. Can i use with that cpu cooling from box? Its not any danger to damage cpu ? I read some reviews that stock cooling from cpu box are very bad.

You are true, but in that review I see somethink extrange to me.

Why is the 5820k maxing the 5930k if the first have lower clock speed and lower turbo than the second?
The two have the same 15Mb cache and same number of cores.

Why are you buying the 4790(K) then if you're not going to OC. Get the non-k version. although I guess $20 isn't much of a difference.

I just upgraded from my i7-960 to the 4790k.
I popped the stock cooler in my test bench and it was running great idle temps... mid 30's. If you don't plan to OC and have a nice ambient temp, im sure you'll be fine. Although Stephenk is right. If you're not overclocking, then why the unlocked version? Just curious. Great Chip BTW
