I was hit in late Dec 2012, and I am about to get a settlement from my insurance - the other insurance company didnt accept liability since the driver apparently took the car without asking (but he was listed on the card he showed me?!).  It has taken roughly 16 months.
 
For the record, I am with AmFam.

I take it you had another car then? Because right now, I will lose everything if I can't get a car within the next month... I have no money and I work 40 miles away so there is no way I can just take a bus or hitch rides...

I had to take a loan from my retirement account to put as a down on another car.  For two months, I made car payments on my new and old car, until my insurance totalled my old car and refunded me the car payments.

if their company wont play ball, your only option is to file the claim on yours and have your insurance reimburse you later

You need to get your attorney to tell the insurance company to "HURRY UP" before you get neck & back pains if you know what i mean.  Usually insurance co's will knock this stuff out...  The quicker they close the claim, the less likely they are to be held responsible for problems later on...  Are you pickin' up what I'm puttin' down?  You are experiencing a lot of "pain and suffering" already since the accident.  You seem stressed out about it.  That's all got a monetary value when the pain is due to the insurance Co. dragging their feet.
 
"Hurry Up before I make this waaay more painful"...  literally.  That may get them going.  Get an attorney interested in representing you and not pushing paper through the system.  He should be able to make it happen real fast....  Insurance companies should fear your lawyer.  The fact they are dragging it out shows that they are not worried about him at all!!!  The best lawyers to get in a traffic accident are the ambulance chasers you see on TV commercials...  They make their living threatening Insurance Co's and the insurance Co's know who they are. 
 
Edit:  In other words, the squeaky wheel gets the grease.  Tell your lawyer to get off his can.  The "they aren't answering the phone" excuse doesn't cut it when you are charging $200-$500/hr to gum up the works... like lawyers do.

If you go to your insurance company it will not effect your price because it was the other drivers fault.
