How long can insurance companies sit on their hands?

So as some of you know, I got hit by an idiot on the freeway on the 27th, and it's the 14th now and his insurance company STILL not accepting liability... My lawyer says they want a recorded statement, but they haven't set it up yet (he told me this 4 days ago, they are still telling him the same thing). I can no longer go to the chiropractor due to not having a car (was getting rides from people). How long can his insurance company delay? I find this a load of BS.

    seems to me that this is regular behaviour from any company that owes you money. They know they owe and just want to not pay cause it hurts their bottom line.

    Go to your insurance and they'll give you the money then sue the other parties insurance company.

    If I use my insurance, I will have to pay for it with higher insurance rates for the rest of my life. No thanks.

    Before you speak with your Ins. agent, contact your attorney and run that by him/her first. You hired this person to represent you in this matter.

    Talk to your insurance company, they will work as you agent to get you back on the road and get payback from the company. If the other company does not accept (which is typical now, or at least delay payout) responsibility, then it will go to arbitration where they will decide who was at fault. If there is personal injury, unfortunately I'd say talk to a lawyer.

    +1....... how long should this take? Not sure,but I cant tell you that if they are dragging it out its because of money for sure. They may be dragging it because the fiscal year ends July 1st, and if they had a bad year they may want to push this payout to the next year.

    Well the court system is backed up by frivolous lawsuits and could take a while to get into court. Cannot believe the UK has a frivolous lawsuit law but we don't.

    rjohnson11 nailed it -- you are paying for an attorney, make sure your attorney is representing your interests.  Once you've retained an attorney, stay away from dealing with either your insurance or the other person's insurance -- that's what you're paying your attorney to do.  Contact them and let them know the hardship(s) you're undergoing, and your attorney may press the issue with the insurance company -- you'll never know until you call, your attorney should be working for you!!

    Yea, I talked to him and I learned that Mercury is the hardest insurance company to deal with... They are like AAA used to be in the old days, except now Mercury just blocks you with automated system and voicemails rather then talking to a real person... And that's what the current problem is, he tries to call them 2-3 times a day, but is lucky to reach them once due to him being ignored. He managed to get ahold of them today luckily to set up the verbal statement so at least we are getting somewhere...

    Yea, he came out ages ago, I would say 2 weeks ago? There is frame damage to my car. And now my car won't turn over, or get power to the radio/clock, dispite the fact that all the fuses are fine.

    Yea maybe... But it's all rear end damage, and it started just fine like a week prior when I started it (had been sitting for about a week). So idk. It was burning oil when I got it to start the last time.

    i suggest a round about way, instead of trying to force the insurance company, sue the driver that hit you directly for damages in this accident, if he is ruled at fault by a judge his insurance company has no choice but to pay :D

    Well I've yet to see a case in a rear end collision where the driver who slammed into the rear of the other car was not cited. Normally it is a violation to keep proper distancing.

    Someone was riding me and I I did that they rear ended me and I won the case because they were not far enough back... Maybe it depends on state?

    You should have a police report that says it's the other persons fault.  An insurance company can't fight that.  Sounds like they are just dragging their feet.  Might be time to start getting tough.
