They can't.  Apparently Corsair has Cherry RBG rights.

Oh, I am not sure but read one of the video comments by Jay2cents say how Corsair had the rights as someone made a similar comment about questioning if another keyboard (EVGA) will have Cherry RBG.  His exact words were, "Corsair owns the Cherry Exclusive in the RGB tech."
