Anyone experiencing tearing on there 970 FTW, even after v-sync?

Hey guys I've been experiencing some tearing on a few of my games (Bastion, Sleeping Dogs, DMC and a few more)
I've applied ingame v-sync and nvidias adaptive v-sync using one of the other of course and im still getting tearing issues. Anyone experiencing this too?
 
Anyway to fix this, maybe it's a driver issue or windows 10?

    well just in general, if you are using adaptive vsync then you will still get tearing below your refresh rate. that said, I have ran into a couple games where even though I am easily pegged at 60 fps, there is  tearing on Win 10. and yes, vsync is flat out not working in a couple of games on Win 10 even though its turned on in game. forcing regular vsync on for any of those games from the cp has fixed the issue though.

    With my 970's I generally leave V-Sync off for 1440p..

    Haven't had an issue or felt the need to ever use VSync. Haven't sense I had a 465GTX.

    The 970FTW is set to a max of 187 watts TDP.  Even at stock clocks, depending on GPU utilization, it can bang up against that max TDP and throttle the GPU clock back.  I got tired of dealing with it, and used a modded bios in the 2nd bios slot.  Why EVGA decided to gimp that card so hard is beyond me, but.....whatever.  I get no throttling and no stutter any more.
